1. Beta Software — Important Notice

The FORTIFIED 123 App is currently provided as a beta release. This means:

• The App is still in active development and testing and may contain bugs, errors, or incomplete features.
• Features may change, be added, or be removed without notice.
• The App may be unavailable, interrupted, or reset at any time, and data (including projects, customer information, and photographs) may be lost, corrupted, or deleted.
• We do not guarantee uptime, performance, data retention, or backup during the beta period.

You are strongly advised to maintain your own independent copies and backups of any customer information, photographs, and project records that you cannot afford to lose. You use the beta App at your own risk.

2. Description of the Service

FORTIFIED 123 is a field-documentation tool designed to help contractors, their crews, and FORTIFIED Evaluators capture, organize, store and transfer photographs and information related to the construction of homes and installation of roofs participating in the FORTIFIED Program to help meet the documentation requirements for FORTIFIED certification as established by the IBHS (Institute of Business and Home Safety).

The App is a documentation and record-keeping tool only. The App does not perform inspections, does not issue FORTIFIED designations, and does not guarantee that any roof, project, or home will qualify for, receive, or maintain any FORTIFIED designation or certification. All FORTIFIED designation decisions are made solely by the Insurance Institute for Business & Home Safety (IBHS) in accordance with FORTIFIED standards. We are not affiliated with, endorsed by, or acting on behalf of IBHS.

You remain solely responsible for the accuracy, completeness, and compliance of all documentation you create, capture, label, or submit using the App, and for verifying that it meets the requirements of the FORTIFIED Program.

3. Eligibility and Accounts

3.1. You must be at least 18 years old and authorized to enter into these Terms on behalf of yourself and any company you represent.

3.2. The App uses role-based accounts (for example, Company Owners, Project Managers, Supervisors, Roofers/Installers, Company Administrators and FORTIFIED Evaluators). You agree to use the App only within the scope of the role assigned to you.

3.3. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3.4. Company account owners are responsible for the users they invite, the roles they assign, and the conduct of users within their organization.

4. Customer Information and Photographs

4.1. Consent. When you capture, upload, store or transfer any photograph or personal information relating to a homeowner, property, or third party, you represent and warrant that you have obtained all necessary permissions and consents to photograph the property and to collect, store, and process that information through the App.

4.2. Accuracy and compliance. You are solely responsible for ensuring that photographs and information are correctly captured, labeled, and associated with the correct project and property. Incorrect, mislabeled, or incomplete documentation may affect FORTIFIED eligibility, and we are not responsible for any such outcome.

4.3. Lawful use. You agree to use customer information only for legitimate purposes related to the construction or roofing project and FORTIFIED documentation, and in compliance with all applicable laws.

5. Data Ownership and License

5.1. Your content. As between you and us, photographs, project records, and customer information you submit ("User Content") are owned by the contracting company associated with the project, subject to any rights of the underlying homeowner or third party.

5.2. License to us. You grant us a limited, non-exclusive license to host, store, process, transmit, and display User Content solely as necessary to operate, maintain, secure, improve, and support the App.

5.3. Our property. The App itself — including its software, design, branding, and underlying technology — is owned by Solid Ground Home Inspections and protected by intellectual property laws. These Terms do not grant you any ownership in the App.

6. Data Security and Privacy

6.1. We take reasonable measures to protect data stored in the App, including access controls, billing information and security rules on our cloud infrastructure. However, no method of electronic storage or transmission is fully secure, and during the beta period we make no guarantee regarding the security, availability, or integrity of data.

6.2. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms for your reference.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any third party's rights;
• Upload content you do not have the right to upload, or that is false, misleading, or fraudulent;
• Attempt to access data or accounts that do not belong to you;
• Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the App or its systems;
• Use the App to misrepresent compliance with any FORTIFIED standard.

8. Fees and Subscriptions

8.1. The App may be offered to you for use free of charge during some or all of the 'beta release' period under specific arrangements communicated to you.

8.2. When paid subscriptions are introduced, applicable pricing, billing cycles, and payment terms will be presented to you and must be accepted before any charges apply.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DATA WILL NOT BE LOST, OR THAT USE OF THE APP WILL RESULT IN ANY FORTIFIED DESIGNATION OR CERTIFICATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR LOSS OF OR FAILURE TO OBTAIN A FORTIFIED DESIGNATION, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless us and our owners, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the App; (b) your User Content; (c) your failure to obtain required consents from homeowners or third parties; or (d) your violation of these Terms or any applicable law.

12. Termination

12.1. You may stop using the App and request deletion of your account at any time by contacting us.

12.2. We may suspend or terminate your access at any time, with or without notice, including if we discontinue the beta program.

12.3. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Charleston County, South Carolina.
